Notice of Intention to
Consider Cancellations (NOICC)
When the Department of Home Affairs issues a Notice of Intention to Consider Cancellation (NOICC), it is a serious step in the immigration process. This document notifies a visa holder that their visa may be canceled due to specific breaches of visa conditions or other concerns, such as character grounds under Section 501 of the Migration Act.
What is a NOICC?
A NOICC is a formal warning that the Department is considering canceling your visa. It allows you to provide reasons and evidence why your visa should not be canceled. The visa holder typically has 28 days to respond.
Common Reasons for a NOICC:
- Non-compliance with visa conditions (e.g. work rights or study obligations)
- Criminal conduct or association with criminal groups
- Providing false or misleading information on your visa application
How to Respond to a NOICC:
- Carefully Review the Notice: Ensure you understand the reasons stated in the NOICC and any deadlines.
- Seek Professional Advice: Immigration lawyers or registered migration agents can help prepare your response.
- Provide Evidence: Responding to a NOICC requires solid evidence to refute the grounds of cancellation. This could include documentation of compliance with visa conditions or character references.
- Submit On Time: Late responses are not accepted, so timely submission is crucial.
Failure to respond to a NOICC canresult in immediate visa cancellation, leading to deportation and potential future entry bans.
